Cookie law info

1. Premise

Website www.gordonshaving.com uses cookies and similar technologies for various purposes like granting the good functioning of procedures and enhancing the experience of using online applications. In particular all objectives pursued by the aforesaid Company through the use of those instruments shall be defined in detail in this document.
In this regard, according to the provisions of art. 13 and art. 122 of Legislative Decree n. 196/2003 (s.c. “Privacy Code”) and to the Privacy Authority Rule of May 8th 2014 (doc. Web. N. 3118884), Labor pro S.r.l., owner of the processing, gives to the users of www.gordonshaving.com site information in detail about the use of cookies (and similar technologies) and also about their utilization and managing methods.

2. Definition and cookie types

2.1. What are cookies?

As the Privacy Authority says, “cookies are small text strings sent by the visited sites to the user’s device (usually to the browser), which stores and then transfers them to the same sites at the next visit of the said user”.
User during browsing can receive on his device (pc, tablet, smartphone) not only cookies sent by the visited website but also by different sites or web servers (s.c. “third parties”).
Some elements on the viewed web page (i.e. images, maps, sounds, links, etc.) are indeed installed by a party other than the owner of the displayed website.
There is usually a very high number of cookies in user’s browser and sometimes they take on a very high level of temporal persistence.
The purposes of their use may be the most varied: from purely technical objectives (aimed to allow an easier and fluid browsing) it is possible to get through their use to actually perform profiling tasks (aimed to define trends, tastes or behavior patterns referable to a specific person to make more effective advertising messages addressed to the latter).

2.2. Which types of cookies are there?

In general cookies can be distinguished into two main categories: a) “Technical” cookies; “Profiling” cookies.

a. Technical Cookies

They’re cookies used with the only objective to “make transmissions of a communication on an electronic communication network or to the extent necessary to the supplier of a service of the information company expressly required by the subscriber or the user to provide the service” (cf. art. 122, par. 1, Privacy Code).
In other words these tools allow the browsing or the supply of a service required by the user.
Without them some operation could not be indeed carried out at all inside the site or they would be more complex (and sometimes less safe). Think for instance to those cookies in a home banking site which allow to keep the identification of the user within a session, avoiding the necessity to continually enter your data (with impact also on the safety profile).
Additional feature of that kind of cookies is the fact that they’re not used for further purposes than those indicated and they’re normally installed by the owner (or website director).
The Privacy Authority proposed the following division on the basis of their function:

I. Browsing cookies: They allow the normal browsing or enjoyment of the website (i.e. those which allow to make a purchase or authenticate to access restricted areas);

II. Analytic cookies (or Analytics): They’re used to monitor the site utilization by the users for optimization purposes (i.e. to collect information in aggregate form on the number of users and how they visit the site). Please remember that, as better specified by the Privacy Authority in the “Clarifications on the implementation of legislation on cookies” of June 5th, 2015, they are treated like technical cookies only if they’re made and used directly by the first party site and without the intervention of third parties [for a clearer explanation on first party and third party cookies please see what is shown below];

III. Functionality cookies: They allow the user to browse according to a set of selected criteria (i.e. language, selected products for the purchase) with the aim to improve the service provided.

b. Profiling cookies

They’re cookies made to create user profiles and they’re used to send advertising messages according to the preferences shown by the latter within the network browsing.
Those tools, pursuant to their own particular invasiveness towards user’s private sphere, need his (informed) explicit consent to be installed in his own device.

Owner cookies and Third party cookies

A further distinction refers to the different party that installs cookies in user’s device.

When you visit a web page you may indeed receive cookies both from the operator of the visited site (in this case they’re called “Owner” or Publisher cookies), both from sites managed by other organizations (s.c. “Third Parties”). An example of the latter category is Google Analytics service.

Finally please remind that analytic cookies, as well as profiling cookies, may be First Party or Third Party ones. According to the objectives of the utilization of third party cookies they’re called “Third party Analytic Cookies” or “Third party Profiling Cookies”.

2.3. Cookies and request of explicit consent

According to the existing legislation in Italy, explicit consent of the user is not always required to use cookies.

While for s.c. technical or first party analytic cookies this is not necessary, the request of that consent is imposed for profiling cookies.

It is necessary to make a proper diversification for what concerns third party analytic cookies.

As exhaustively reported by the Privacy Authority in the infographic of June 10th, 2015 and also on point 2 of the “Clarifications on the implementation of legislation on cookies” of June 5th, 2015, it is distinguished depending on whether:

a. Instruments are adopted to reduce the indentifying power of cookies and the third party doesn’t cross information collected with other than it already has. In this case no consent from the user is required;

b. Instruments are NOT adopted to reduce the indentifying power of cookies and the third party doesn’t cross information collected with other than it already has. In this case consent from the user is required.

3.Types of cookies used on site
